Pursuing a Vaginal Mesh Claim

Most of the pelvic vaginal mesh cases are being litigated through the Multi-District Litigation pending in the United States District Court for the Southern District of West Virginia at MDL 2327.  The cases were assigned via an order from  the Multi District Litigation Panel, which is an arm of the Federal Court system that addresses mass torts, among other types of large claims. In situations where there is a mass tort (i.e. a large number of cases arising from a single product or procedure or situation), these cases are often joined through the Multi District Litigation Panel.  Essentially, the MDL Panel issues an order  assigning all of the cases to one Federal District  Court for handling on a mass scale.  The litigation is then often streamlined and procedures are set up for certain filings and the Plaintiffs/Victims are then required to file certain documents in order to continue to participate in the lawsuit.  This is what has occurred in the vaginal mesh cases.  In the vaginal mesh cases, the litigation is known as MDL 2327 Ethicon, Inc., Pelvic Repair System Products Liability Litigation and is assigned to the Honorable Joseph R. Goodwin. A link to forms and the Court’s website can be found at:
