On February 17, 2016, in the Durom Cup hip replacement products liability cases, the attorneys for Zimmer, Inc. (“Zimmer”) announced that it has signed a settlement agreement to resolve virtually all lawsuits and claims in the United States for plaintiffs and claimants who were implanted with a Durom Cup and subsequently had a Durom Cup removed. The Agreement establishes a settlement program intended to efficiently register, categorize and finally settle Durom Cup lawsuits and claims by the end of 2016. The Settlement Agreement has been circulated to law firms representing Durom Cup plaintiffs, including Patberg Law Firm.
Durom Cup released its Durom Cup implant in 2006. Thousands of patients have received the component but, eventually, Zimmer suspended its sales because of mounting complaints and injuries to patients. This resulted in thousands of Durom Cup lawsuits which were eventually consolidated into the United States District Court for the District of New Jersey. The terms of the settlement are complicated and it is strongly suggested that any claimants retain independent counsel.
ANY CLAIMANTS MUST BE REGISTERED BY APRIL 29, 2016 to be eligible to participate in the settlement program. As such, it is strongly suggested that Durom Cup patients obtain counsel immediately. Read the Durom Settlement Agreement.
